Picky Mouse Terms of Service and End User License Agreement (EULA)

Welcome to Picky Mouse.

These Terms of Service ("Terms") govern your access to and use of the Picky Mouse website, mobile applications, and related services (collectively, the "Service").

The Service is operated by Yeh Solutions LLC, doing business as Picky Mouse ("Picky Mouse," "we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Eligibility

You must be at least 13 years old, or the minimum age required by law in your jurisdiction, to use the Service.

By using the Service, you represent and warrant that:

  • You are legally capable of entering into a binding agreement.
  • You have the authority to accept these Terms.
  • The information you provide is accurate and current.
  • Your use of the Service complies with applicable laws and regulations.

2. Description of the Service

Picky Mouse is a platform that enables users to discover, rate, review, save, and discuss dishes and restaurants.

The Service may include:

  • User-generated reviews
  • Ratings
  • Photos
  • Public profiles
  • Social features
  • Restaurant and dish information
  • Personalized recommendations
  • Location-based functionality

We may modify, suspend, or discontinue any portion of the Service at any time.

3. Accounts

Certain features require an account.

Accounts may be created using supported authentication methods, including:

  • Email One-Time Password (OTP)
  • Google Sign-In
  • Apple Sign-In

You are responsible for:

  • Maintaining the security of your account
  • All activity occurring under your account
  • Ensuring information associated with your account remains accurate

You may not:

  • Share your account credentials
  • Allow another person to access your account
  • Create accounts for fraudulent purposes
  • Impersonate another individual or organization

4. User Content

Users may submit content through the Service, including reviews, ratings, photos, profile information, comments, and feedback.

You retain ownership of the content you create and submit.

You are solely responsible for the content you post and any consequences resulting from that content.

5. License Granted to Picky Mouse

By submitting content to the Service, you grant Picky Mouse a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, display, publish, distribute, modify for formatting and technical purposes, and promote your content in connection with operating, improving, marketing, and providing the Service.

This license continues until the content is deleted from our systems, except where retention is reasonably necessary for legal compliance, dispute resolution, security, fraud prevention, auditing, or legitimate business purposes.

6. Content Standards

You agree that content submitted to the Service will be truthful and lawful. You may not submit content that is false or misleading, contains fake reviews, manipulates ratings or rankings, violates intellectual property rights, contains pornography or sexually explicit content, promotes violence or illegal activity, harasses, threatens, or abuses others, contains hate speech, includes malware or malicious code, or constitutes spam or unsolicited advertising.

Additional standards are described in the Picky Mouse Community Guidelines.

Picky Mouse enforces a strict zero-tolerance policy for objectionable content or abusive behavior.

7. Reviews and Ratings

Reviews should reflect genuine personal experiences and opinions. You may not post fake reviews, exchange compensation for reviews without proper disclosure, create multiple accounts to influence ratings, or coordinate review manipulation campaigns.

We reserve the right to remove reviews that violate these Terms or our Community Guidelines.

8. Photos and Media

Users may upload photos and other media to the Service. By uploading photos, you represent and warrant that you own the content or have permission to share it, the content does not violate applicable law, and the content does not infringe the rights of others.

Photos may be reviewed through automated and manual moderation processes. We may remove, restrict, or moderate content that violates our policies.

9. Public Content

Many areas of the Service are public. Information that may be publicly visible includes your username, display name, reviews, ratings, review photos, and public profile information.

You should not submit information you do not want publicly displayed.

10. Restaurant and Dish Information

Information displayed on the Service may originate from users, business owners, third-party providers, or public sources. We do not guarantee the accuracy, completeness, availability, or reliability of restaurant information, menus, pricing, hours of operation, availability, dish descriptions, or locations.

Users should independently verify important information before relying on it.

11. Prohibited Conduct

You agree not to violate any law or regulation, scrape or harvest data from the Service, reverse engineer the Service, circumvent security measures, interfere with platform functionality, use automated systems without authorization, create fake accounts, engage in fraud or deceptive practices, access another user's account without permission, attempt to disrupt the Service, or upload malicious software or code.

12. Intellectual Property

The Service, including software, branding, design elements, graphics, and other content provided by Picky Mouse, is protected by intellectual property laws. Except as expressly permitted by these Terms, you may not copy, reproduce, modify, distribute, sell, license, or create derivative works without our prior written permission.

13. Feedback

If you provide suggestions, ideas, feedback, or recommendations regarding the Service, you grant Picky Mouse the right to use those suggestions without compensation or restriction.

14. Account Suspension and Termination

We may suspend, restrict, or terminate accounts at our discretion if we reasonably believe these Terms have been violated, Community Guidelines have been violated, fraudulent activity has occurred, security risks exist, or legal obligations require action.

We may also remove content that violates our policies.

Any reported content that violates these safety standards will be reviewed and removed within 24 hours, and the offending user's account may be immediately and permanently terminated.

15. Account Deletion

Users may request account deletion through the Service. Account deletion is governed by the Picky Mouse Account Deletion Policy.

Certain information may be retained following deletion as required by law or for fraud prevention, security, auditing, recordkeeping, dispute resolution, or legal compliance.

16. Third-Party Services

The Service may rely on or integrate with third-party services, including Google services, Apple services, authentication providers, hosting providers, cloud storage providers, and content moderation providers.

We are not responsible for third-party services or their policies. Your use of third-party services may be subject to separate terms and policies.

17. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PICKY MOUSE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND RELIABILITY.

WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

18. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PICKY MOUSE, YEH SOLUTIONS LLC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, LOSS OF PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

19. Indemnification

You agree to defend, indemnify, and hold harmless Picky Mouse, Yeh Solutions LLC, its affiliates, officers, employees, contractors, and agents from claims, damages, liabilities, losses, and expenses arising out of your use of the Service, your content, your violation of these Terms, your violation of applicable law, or your infringement of another person's rights.

20. Changes to the Service

We may modify, suspend, restrict, or discontinue any part of the Service at any time without liability. We are not obligated to maintain any specific feature or functionality.

21. Changes to These Terms

We may update these Terms from time to time. The updated version becomes effective upon posting unless otherwise stated. Your continued use of the Service after updates constitutes acceptance of the revised Terms.

22. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict-of-law principles.

23. Severability

If any provision of these Terms is determined to be unenforceable, the remaining provisions shall remain in full force and effect.

24. Entire Agreement

These Terms, together with the Privacy Policy, Community Guidelines, and Account Deletion Policy, constitute the entire agreement between you and Picky Mouse regarding the Service.
